If the exclusion item was not generated by recommendation of the Yurok Tribal Court or the Gaming Commission, then Tribal Council shall only enter a temporary exclusion order and refer the exclusion to the Yurok Tribal Court for recommendation. Upon referral to Tribal Court, the Office of the Prosecutor shall review the case and may exercise its discretion to decline to prosecute. If the Prosecutor declines to prosecute, the Office of Tribal Attorney may prosecute with the same authorities as the Prosecutor under this chapter. [Ord. 80 § 1202, adopted, 10/6/2022.]
