Article II. Grounds for Exclusion

Exclusion shall only be used in extreme and serious cases, often after other means of resolution have been exhausted. Tribal Council, Tribal Court, and the Gaming Commission should consider a person’s personal history and avenues for the person’s return to the community in reviewing grounds for exclusion. A person may be excluded from Yurok lands under the jurisdiction of the Tribe for any of the following reasons, which are considered to be particularly serious:

(a) Repeated invasion of the privacy of Tribal members or Reservation residents as evidenced by restraining orders against that person for three or more different instances.

(b) Conviction within the previous three-year period of one felony domestic violence offense or multiple domestic violence offenses that involve physical injury or sexual assault.

(c) Conviction within the previous seven-year period of a serious felony, including arson, murder, rape, assault with a deadly weapon, or a sexual offense against a minor.

(d) Illegal controlled substance production, manufacture, trafficking, distribution, or cultivation of more than 99 marijuana plants within the Reservation.

(e) Abuse of an elder.

(f) Repeated or especially serious illegal damage to the property or natural resources of the Tribe.

(g) Repeated trespass onto Yurok lands, including for such purposes as the production or cultivation of an illegal controlled substance, as evidenced by at least three convictions for trespass or a similar offense.

(h) Conviction of crimes committed on or off the Reservation related to grave looting.

(i) Exclusion from a neighboring reservation for offenses stated herein.

(j) Violations of Yurok law where Council has provided for exclusion as a remedy by Tribal ordinance.

(k) Any other serious or extreme misconduct that threatens the life, health, or safety of a Reservation resident or the Tribe and is found by the Tribal Council to be serious cause for exclusion. [Ord. 80 § 1101, adopted, 10/6/2022.]
