Notice to the person in Tribal Court or Tribal Gaming Commission proceedings to be excluded shall comply with the following requirements:

(a) Be by personal service, or by first class mail, return receipt requested, to the person’s last known address. If notice is by mail, then service shall be deemed complete upon the date of the return receipt. Service to a legal entity shall be by any of the above methods to the designated agent for service.

(b) Be served no later than 10 days prior to the hearing date.

(c) State the date, time, and location of the hearing before Tribal Court or Gaming Commission at which exclusion shall be sought.

(d) State the grounds for an exclusion order, including a brief summary of facts which serve as the basis for the proposed exclusion.

(e) State the areas for which exclusion is sought.

(f) Name any witnesses to be called in support of the proposed exclusion order.

(g) Inform the person of the right to be represented by private counsel, to present evidence and witnesses, and to cross-examine adverse witnesses. [Ord. 80 § 1203, adopted, 10/6/2022.]
