(a) “Permanent total disability” is a disability which the administrator has determined precludes the injured employee from any and all gainful employment. There shall be no presumption of permanent total disability.

(b) Compensation shall be paid at the same rate as is paid for temporary disability benefits.

(c) The employee and Tribe may elect to settle permanent disability benefits by the payment of a lump sum. [Ord. 47 § 1404, adopted, 11/10/2016.]
