The Tribal Court may require a plaintiff, other than the Tribe and YIHA, to file an undertaking with good and sufficient sureties in a sum to be fixed and determined by the Tribal Court. If the plaintiff fails to recover judgment against the defendant for the possession of the premises or if the suit is dismissed, the Tribal Court may order the plaintiff, other than the Tribe and YIHA, to pay the defendant such damages, not to exceed the amount fixed in the undertaking, as may be sustained by the defendant by reason of such dispossession under the writ of possession. An action to recover such damages shall be commenced by the defendant in Tribal Court within six months from the date of entry of dismissal or of final judgment in favor of the defendant.
