(a) YTEP may inquire about, identify, and investigate persons subject to regulation who have failed either to obtain a permit when required or to comply with permit conditions. YTEP may receive and shall investigate information submitted by the public regarding asserted violations of this chapter.

(b) Permittees shall allow YTEP, upon presentation of proper identification, at reasonable times to:

(1) Enter upon the permittee’s premises where a regulated activity is located or where records must be kept under the conditions of the permit;

(2) Have access to and copy any records that must be kept under the conditions of the permit;

(3) Inspect operations regulated or required under the permit; and

(4) Sample or monitor any substances or parameters at any location for the purposes of assuring permit compliance or as otherwise authorized by the Clean Water Act.

(c) Inspections conducted and information obtained under this section shall facilitate production of evidence admissible in enforcement proceedings. [Ord. 67 § 5202, adopted, 5/21/2020.]
