(a) Any person who violates this chapter shall immediately notify YTEP of the violation and fully disclose information regarding the violation, including the location, amount, and type of any unauthorized regulated activity.

(b) For any violation that YTEP identifies, YTEP or the Yurok Tribe Department of Public Safety shall notify the responsible party of the violation. The violator shall immediately abate the violation. If the violation cannot be immediately abated, the violator shall promptly submit to YTEP a plan to complete abatement of the violation as soon as possible after the notice.

(c) Any person who violates this chapter shall be liable for all costs associated with or necessary to abate and remediate such activity to restore the conditions that existed immediately before the activity and to otherwise comply with this chapter and ensure compliance with the Tribe’s water quality standards.

(d) Failure to complete and pay for abatement and remediation as required by YTEP shall be subject to enforcement in accordance with this chapter. [Ord. 67 § 5203, adopted, 5/21/2020.]
