(a) Except when a regulated activity is authorized by a general permit or is exempt from the requirements to obtain a permit, any person who proposes a regulated activity shall complete, sign, and submit a permit application to YTEP. Persons proposing regulated activity under the authorization of a general permit must comply with any reporting requirements of the general permit.

(b) A complete application shall include:

(1) Name, physical, mailing, and email addresses, and telephone number of the applicant and name(s) and address(es) of adjoining property owners;

(2) A complete description of the proposed activity including location maps and site plans of wetlands, hydrological features, buffers, and proposed activities sufficient for review and public notice; the location, purpose, and intended use of the proposed activity; scheduling of the activity; the location and dimensions of adjacent structures; and a list of authorizations required by other Tribal, federal, interstate, state or local agencies for the work, including all approvals or denials already issued;

(3) A description of the type, composition, source, and quantity of the material to be discharged and the method(s) of discharge(s) if any, best management practices to be implemented with citations to relevant provisions of any supporting approved reference manual, and the site and plans for disposal of the dredged or fill material if any;

(4) A certification that all information contained in the application is true and accurate and acknowledging awareness of penalties for submitting false information;

(5) Information on all activities which the applicant plans to undertake which are reasonably related to the same project; and

(6) Such additional information as YTEP deems appropriate to assist in the evaluation of the application, including without limitation environmental data and information on alternate methods and sites as may be necessary for preparation of the required environmental documentation.

(c) The level of detail in a permit application shall be reasonably commensurate with the type and size of activity, proximity to critical areas, likelihood of long-lived toxic chemical substances, and potential level of environmental degradation.

(d) Any person who submits a permit application to YTEP shall provide notice and a complete copy of the application to the EPA, and certify that to YTEP.

(e) An application shall be signed by the applicant or the applicant’s duly authorized representative accompanied by a statement of that authorization. The signature shall constitute an affirmation that the applicant possesses the requisite property interest to undertake the proposed activity. [Ord. 67 § 5107, adopted, 5/21/2020.]
