(a) YTEP shall provide notice to the EPA of every action for which public notice is required under YTC 21.55.190(a).

(b) If a proposed regulated activity may affect the biological, chemical, or physical integrity of the waters of any state or tribe other than wetlands or waters of the Reservation, YTEP shall provide an opportunity for such state or tribe to submit written comments within the public comment period and to suggest permit conditions. If those recommendations are not accepted by YTEP, YTEP shall so notify in writing the affected state or tribe and the EPA before permit issuance together with reasons therefor. The EPA shall then have the time provided for in 40 C.F.R. Section 233.50(d) to comment on, object to, or make recommendations.

(c) Consideration and issuance of permits under this chapter shall be coordinated with review under other Yurok ordinances, as well as federal and federal-state water related planning and review processes. [Ord. 67 § 5108, adopted, 5/21/2020.]
