No contractor may commence work until the contractor has submitted to TERO an Indian preference plan, negotiated with and approved by the TERO Officer, setting forth how the contractor intends to meet the contractor’s obligations under this division. The Indian preference plan should list by occupational classification all key and nonkey employee positions to be used by the contractor.

For multi-year contracts, the Indian preference plan shall be reviewed at least annually, or sooner at the request of a contractor or the discretion of the TERO Officer, and shall be revised to reflect changes in the number of Tribal members or Indians available or in the contractor’s hiring plans and practices.
