Arraignment shall be held in open Court with the defendant present, and, unless time is waived by the defendant with the concurrence of the Court, shall take place within five days after the initial appearance.

(a) At the arraignment the Court shall:

(1) Read to the accused, and determine that he or she understands the complaint, the section of the Yurok Code which he or she is charged with violating, including the maximum authorized penalty.

(2) Determine the defendant’s plea of not guilty, guilty, or no contest. Unless the defendant pleads guilty or no contest, the Court shall enter a plea of not guilty on the defendant’s behalf.

(3) Hear and decide motions concerning the conditions of release.

(4) Set the date of trial.

(5) Advise the parties in writing of the dates set for further proceedings and other important deadlines. [Ord. 81, amended, 1/6/2023; Ord. 63, adopted, 12/6/2019.]
