(a) Request for Entry of Default. If a responsive pleading is not served within 20 days after service of the complaint and no extension of time has been granted, the petitioner may file a request for entry of default within 10 days after the time for service has elapsed or orally at a hearing scheduled after the time allotted for responsive pleading has expired.

(b) Default Judgment. When a default is entered, the party who requested the entry of default must obtain a default judgment against the defaulting party within 45 days after the default was entered, unless the Court has granted an extension of time.

(c) Dismissal for Failure to Prosecute. If petitioner fails to appear for the hearing, fails to file proof of service of the petition within 60 days of the initial filing, fails to request alternative service, or fails to file for a default judgment as provided in subsection (b) of this section, the Court or Court Clerk may dismiss the complaint without prejudice, and without further notice to the petitioner.
