(a) Offenses hereby considered as misdemeanors may be punished by imprisonment not to exceed one year, a fine of $5,000.00, or both. Further, offenses that constitute a misdemeanor, but have aggravating factors as defined in this chapter, may be enhanced to a felony.

(b) Definitions of Misdemeanor Offenses.

(1) “Assault” means:

(A) Whoever knowingly within the territory or jurisdiction of the Yurok Tribe commits an act with intent to cause fear in another of imminent bodily harm or death, intentionally inflicts or attempts to inflict bodily harm upon another; or

(B) Whoever within the territory or jurisdiction of the Yurok Tribe touches another person willfully in a manner that can reasonably be construed as harmful or offensive.

(2) “Destruction of property” means whoever, within the territory or jurisdiction of the Yurok Tribe, knowingly causes an injury to real or personal property through negligent behavior, or through willful destruction.

(3) “False imprisonment” means whoever, in the territory or jurisdiction of the Yurok Tribe, knowingly, intentionally and unlawfully restrains, confines, or detains another person through force, or threat of force; and/or intentionally and unlawfully restrains, confines, or detains someone through fraud, deceit, trickery, or duress.

(4) “Harassment” means whoever, in the territory or jurisdiction of the Yurok Tribe knowingly, with the intent to harass, annoy, or alarm another person:

(A) Follows the other in or about a public place or places;

(B) Engages in a course of conduct or repeatedly commits acts which serve no legitimate purpose;

(C) Communicates to or about such other person any lewd, lascivious, threatening or obscene words, language, drawings, or caricatures;

(D) Communicates repeatedly in an anonymous manner;

(E) Communicates repeatedly at extremely inconvenient hours;

(F) Communicates repeatedly in an offensive manner other than specified in subsections (b)(4)(C), (b)(4)(D), and (b)(4)(E) of this section; or

(G) Intentionally violating a valid protective or restraining order. [Ord. 62B § 4102, amended, 11/7/2019.]
