Article VII. Recovery of Payments Made in Error

Whenever the administrator pays a claim under this chapter as a result of a clerical error, mistaken identity, innocent misrepresentation by or on behalf of the payment recipient, or because of any other similar circumstances not involving fraud, the recipient shall refund the payment to the administrator. The administrator must request such refund(s) within one year of making the payment, or the administrator will waive the refund claim. The administrator may exercise his or her discretion to waive, in whole or in part, the amount of any such timely claim where the recovery would be against equity and good conscience.
