(a) When an injury causes death within three years from the date of the injury, the casino shall be liable for compensation to the dependent of the injured employee as provided for in this section. The dependent must be qualified as defined in this chapter, and must be totally or partially dependent upon the injured worker, at the time of the injury and at the time of death in, order to qualify for benefits.

(b) The death benefit payable under this chapter shall be comparable to those death benefits payable under state law at the time of the employee’s death. However, nothing herein shall mandate that the Tribe provide the exact same benefits recoverable under state law. In no instance shall the amount payable to an employee’s dependents exceed $500,000.
