Tribal Council finds and declares that:

(a) The ordinance codified in this chapter has been adopted by the Council after careful thought and consideration pursuant to the Constitution of the Yurok Tribe in which the power and authority granted under Article IV, Section 5(a) states that the Council may “enact legislation, rules, and regulations not inconsistent with this Constitution to further the objectives of the Yurok Tribe…”

(b) Included within the Tribe’s right to sovereignty and self-determination is the right to define and maintain a Tribal workers’ compensation program to protect the health, welfare and safety of casino employees.

(c) The Yurok Tribe values workplace safety and desires to establish a systematic and uniform procedure for administration of workers’ compensation benefits to all casino employees.

(d) The Yurok Tribe desires to provide sure and prompt medical treatment for injured casino employees, and fair, adequate and reasonable income benefits to injured casino employees and/or their dependents.

(e) This chapter will provide the sole and exclusive source and means by which casino employees and/or their dependents may seek and qualify for remedies for injuries arising out of and in the course of employment with the Tribe. [Ord. 47 § 1002, adopted, 11/10/2016.]
