The Yurok Tribal Court shall review an appeal of the Executive Office’s determination of factual findings for clear and convincing evidence of an error. Clear and convincing evidence means that the Tribal Court has a definite and firm conviction that the Executive Office’s decision contained an unquestionable mistake. The Tribal Court shall review legal findings de novo, without any deference to the Executive Office’s determination. [Ord. 58 § 4902, amended, 5/9/2019; Ord. 34 § 4902, adopted, 2/6/2014.]
