Any customer or any applicant for utility services who is aggrieved by any action of the utility district or the staff of the Yurok Public Utility District may file a grievance with the utility authority. The utility authority shall abide by the regulations set forth in this title and shall handle such grievances in a manner which provides for due process and in compliance with the Constitution and laws of the Yurok Tribe.

All decisions made by the utility authority on matters that have been submitted for grievance under the Yurok Public Utility District’s grievance procedures shall be considered final. Final decisions of the utility authority may be appealed to the Tribal Council by an aggrieved party only on the basis that the Yurok Public Utility District’s grievance procedures were not followed or that due process was denied. The Tribal Council hereby waives the Tribal sovereign immunity of the Yurok Public Utility District for cases in Tribal Court only as allowed by this section.
