Unless the context specifically indicates otherwise, the meaning of terms used in this title shall be set forth in this section.

“Appurtenances” means the real and personal property owned by the Yurok Public Utility District or the Tribe located on, near, or under the roadways and streets, such as fire hydrants and valves.

“Collection lines” means those sanitary sewerage lines maintained by the Yurok Public Utilities District which sanitary sewer collection and disposal services are provided to customers.

“Contractor” means an individual, firm, contractor, consultant, or organization who contracts with the Yurok Public Utilities District to provide environmental or utility repairs, design, inspection, reconstruction or any special services.

“Customer” means a person, business, agency or other organization that benefits, uses, is entitled to use, or is obligated to pay for the maintenance, use, or receipt of services from the Yurok Public Utility District. For purposes of this title “customer” may include nonresident landowners that are beneficiaries by virtue of the establishment of community services by the Yurok Public Utility District.

“Customer lines” means any and all utility lines, or any means of transmission to the customer utilized by the Yurok Public Utility District. For example, the potable water lines located immediately adjacent to, inside of, or under a customer’s residence or other building or property, which are either connected to utility service lines or are maintained by the customer separately from utility service lines.

“Garbage” means all degradable and nondegradable refuse and solid waste with or without economic value that is generated through the course of normal living by the residents and organizations in the community.

“General manager” means an individual hired by or appointed by the Yurok Public Utility Authority to oversee and manage the entire operation of the Yurok Public Utility District.

“Manager” means individuals hired by or appointed by the Yurok Public Utility Authority to oversee and manage bureaus or sections of the Yurok Public Utility District.

“Meter” means a device, owned by the Yurok Public Utility District, for measuring the amount of water, power or other utility services provided to a particular customer.

“Off-reservation” means any area located outside of the exterior boundaries of the Yurok Reservation.

“Operator” means an individual hired by or appointed by the Yurok Public Utility Authority or a manager to provide direct day-to-day preventive maintenance and operational service for any of YPUD utilities (ex: water treatment plant operator or network operator).

“Regulation” means a rule of law or procedure duly adopted by the Yurok Public Utility Authority for purposes of implementing the requirements of this title.

“Subsurface drain field” means an underground system to dispose of waste water.

“Tribal community,” for purposes of this title, shall include, but not necessarily be limited to, enrolled Yurok Tribal members and other residents of the Yurok Reservation, members of Tribal business, and educational communities, who are involved with the Tribe and its activities.

“Utilities” means those services necessary for supporting residential and commercial development, including, but not limited to, water, sewer, garbage collection, fire protection, power, communications, and appurtenances.

“Utility authority” means the board of directors of the Yurok Public Utility District, as established by this title. In the absence of a utility authority or board of directors, the Tribal Council shall assume all responsibilities and duties of the utility authority.

“Vendor” means any individual firm, contractor, supplier, manufacturer, store or organization who regularly supplies parts, equipment, supplies and services to the Yurok Public Utilities District used in the operation, maintenance and management of the Yurok Public Utilities District.
