“Applicant” means any person who submits a building permit application for the purpose of obtaining approval under this chapter.

“Building” means any structure, either temporary or permanent, having a roof and used or built for shelter or enclosure of persons, animals, or property of any kind.

“Building Official” means the officer or other designated authority charged with the administration and enforcement of this code, or a duly authorized representative.

“Constitution” means the Constitution of the Yurok Tribe, as ratified on November 19, 1993.

“Construction documents” means written, graphic, and pictorial documents prepared or assembled for describing the design, location and physical characteristics of the elements of a project necessary for obtaining a building permit.

“Council” means the Yurok Tribal Council.

“Detached building” means a separate single-story building, without a basement or crawl space, used for storage or use of hazardous materials and located an approved distance from all structures.

“Eligible applicants” means property owner, or owners, or an authorized agent of the property owner, or owners.

“Lot” means a designated parcel, tract, or area of land established by a plat, subdivision, or considered as a unit of property by virtue of a metes and bounds description, to be separately owned, used, developed, or built upon.

“Minor deviation” includes one or more of the following:

(1) An increase or decrease of less than 10 percent of the size of the gross area of any yard, open space, working area, or parking area;

(2) An increase or decrease of less than 10 percent of the size of any building or structure, or the total land area covered by any building or structure, provided the land area is covered by all other relevant permits allowing intended use and increase;

(3) An increase or decrease of less than 10 percent of the height of any building or structure or of any part thereof, or of the depth or area of an excavation, slope, or working area; or

(4) An increase in the number of buildings or structures shown on the plot plan so as not to increase by more than 10 percent of the total land area of the structures.

“Plot plan” means a formal map which shows lots on the map.

“Reservation” means all lands and waters within the exterior boundary of the Yurok Reservation.

“Tribal land” means the area over which the Tribe exercises criminal or civil regulatory jurisdiction, and includes the following:

(1) All land within the exterior boundaries of the Tribe’s Reservation;

(2) All lands held in trust for the Tribe by the United States; and

(3) Other lands defined by applicable law to be within said jurisdiction of the Tribe.

“Use” means the purpose for which land or a building thereon is designed, arranged, or intended to be occupied or used, or for which it is occupied or maintained. [Ord. 50.1 § 4009, adopted, 5/11/2017.]
