(a) YTEP will review all applications for compliance with the CWA Section 404(b)(1) Guidelines, applicable environmental criteria of the Tribe, as well as any other applicable laws or regulations.

(b) YTEP shall consider all comments received in response to the public notice, and permit hearing if a hearing is held. All comments, as well as the record of any permit hearing, shall be made part of the official record on the application.

(c) After YTEP has completed its review of the application and consideration of comments, YTEP will decide, in accordance with the record and all applicable regulations, whether or not the permit should be issued. YTEP shall prepare a written decision on each application explaining the decision. The decision shall be dated, signed, and included in the official record before final action on the application.
