The following regulated activities are exempt from permitting requirements under this chapter where such activities are conducted in accordance with best management practices, to assure that flow and circulation patterns and chemical and biological characteristics of the waters and wetlands are not impaired, that the reach of navigable waters is not reduced, and that any adverse effect on the aquatic environment or Tribal beneficial uses will be otherwise minimized:

(a) For maintenance, including emergency reconstruction of recently damaged parts, of currently serviceable structures such as breakwaters, causeways, dams, dikes, groins, levees, riprap, and bridge abutments or approaches, and transportation structures;

(b) For construction of temporary sedimentation basins on a construction site which does not include placement of fill material into the navigable waters;

(c) For Tribal ceremonial or cultural activities; and

(d) For wetland restoration or management activities as approved by the Tribe. [Ord. 67 § 5104, adopted, 5/21/2020.]
