(a) YTEP may issue general permits for categories of similar activities that will cause only minimal adverse effects to the environment and Tribal beneficial uses when performed separately and will have only minimal cumulative adverse effects on the environment and Tribal beneficial uses.

(b) In addition to the conditions specified in YTC 21.55.230, each general permit shall comply with the CWA Section 404(b)(1) Guidelines and contain the following:

(1) A specific description of the type(s) of activities which are authorized, detailed enough to ensure that the requirements of this section are met, including limits for any single operations; and

(2) A precise description of the geographic area where the general permit applies, including limits on the type(s) of waters or wetlands where operations may be conducted sufficient to ensure that the requirements of this section are met.

(c) YTEP may, without revoking a general permit, require any person authorized under a general permit to apply for an individual permit based on concerns for the aquatic environment including without limitation the CWA Section 404(b)(1) Guidelines. [Ord. 67 § 5103, adopted, 5/21/2020.]
