This chapter shall apply to all persons, corporations, and entities throughout and within the Yurok Reservation, including over all lands, waters, riverbeds, submerged lands, properties, air space, minerals, fish, forests, wildlife, and other resources, and any interest therein now or in the future. This chapter shall also apply to any off-reservation conduct that causes material on-reservation chemical trespass or contamination.

Commentary: The Yurok Tribe has documented many instances in which pesticide use outside the Reservation boundaries often drifts onto the Reservation via air and water, and seeps through the soil into the Reservation. Pesticide trespass onto the Yurok Reservation has direct impacts on core governmental interests: the public health and welfare, economic security, and governmental integrity public health, which the Tribe may regulate as provided in Montana v. U.S. EPA, 137 F.3d 1135 (9th Cir. 1998).
