(a) All applicable compliance requirements will be determined on a case-by-case basis by the Committee based upon the specifics of a proposed plan or application and applicable law.

(b) All compliance requirements must be completed at the cost of the applicant and prior to the approval and permitting of any application under this chapter. Any monitoring requirements identified in the completion of the compliance process will become terms and conditions of operations for any permit issued under this chapter and must be completed at the cost of the applicant.
