Rule 2. Location of Court, Filing, Location of Court Sessions

The intention of these rules is to notify those seeking to use the Court of where and how to initiate and proceed with actions.

(a) The Office of the Court Clerk shall be located at:

(b) Documents can only be filed by the Clerk of the Court, or a person designated as an associate clerk (or by a judicial officer of the Court) for the purposes of filing/receiving documents.

(c) Filing shall be effective upon presentation of document(s) to the Court personnel in the office of the Court Clerk; or upon receipt of a document in the office of the Court Clerk via United States mail identified as a document to be filed; or by the Court Clerk email; depositing in the drop box to be filed when offices are closed and filing via fax is specifically allowed. The date and time of the filing will be that of the day’s business hours; any filing after the close of business, no matter what format or location, will not be dated until the following business day begins. Filing via the drop box requires notifying the Court Clerk of the location of the filing via telephonic or e-mail contact. The filing date for filing via the drop box is the date that the filing is retrieved by the Clerk; failing to notify the Clerk of the filing via the drop box may result in missed deadlines and any consequences that follow. Filing in any location or by any method other than as provided by this rule is ineffective.

(d) Late filing of material may be permitted by order of Court provided good cause is shown. An affidavit of good cause must accompany any late filing. Any late filing will need to conform to all other rules of Court.

(e) The hours of the Court shall be from 8:30 a.m. to 4:00 p.m. with a one-hour lunch period from 12:00 p.m. to 1:00 p.m., said lunch period will be a Court closure, Monday through Friday, except on all Tribal and federal holidays. On occasion, the Court may have to close due to power outages, inclement weather, pandemics, or other disasters. If the Court closes unexpectedly all attempts will be made to notify affected parties and a sign will be posted on the door. Business hours and modifications of business hours will affect the filing date pursuant to YTC 2.10.050(c).

(f) Court sessions may be held at: Yurok Tribal Court – Klamath 230 Klamath Blvd., Klamath, CA; Yurok Tribal Office – Weitchpec Highway 96, Weitchpec, CA; or other locations as designated by order of the Court.
