(a) A list of eligible jurors shall be prepared by the Court. The eligible juror list shall be updated no less than once per year. The Court shall provide for the selection of names of persons eligible for service as jurors.

(b) A list of at least 21 enrolled Yurok members, and in the case of the Tribe exercising Special Criminal Domestic Violence Jurisdiction, a list of at least 21 other Indian and non-Indian residents of the Yurok Reservation community, who are eligible for jury duty shall be prepared and maintained by the Court Clerk.

(c) Should the Tribe exercise Special Criminal Domestic Violence Jurisdiction, both juror lists may be combined when selecting a panel of potential jurors.

(d) Under the supervision of the presiding judge, a panel of jurors shall be drawn by lot from the jury list. A trial jury shall consist of six qualified jurors selected from a panel of 12 eligible persons taken from the jury list, with one alternate juror selected in the same manner as a regular juror.

(e) If the jury panel is exhausted before a sufficient number of jurors are selected for the trial jury, additional jurors shall be drawn by lot from the jury list for the panel until a trial jury is selected.

(f) Jurors shall be 18 years of age or older and, notwithstanding any other law of the Yurok Tribe or any of its agencies, may be chosen from the following classes of persons:

(1) Tribal members living on or near the Yurok Indian Reservation;

(2) Residents of the Yurok Indian Reservation;

(3) Employees of the Yurok Tribe or any of its enterprises, agencies, subdivisions, or instrumentalities who have been employed by the Yurok Tribe for at least one continuous year prior to being called as a juror; and

(4) Customers who use Yurok Tribal utilities such as power, water, internet, sewer, gas, phone, or other similar service provided by the Tribe.

(g) An eligible juror shall be:

(1) Of sound mind and discretion;

(2) Never been convicted of a felony;

(3) Is not a judge or justice;

(4) Is not an officer or employee of the Court, the Tribal Prosecutor’s Office, or an employee of the Tribal Police;

(5) Not otherwise disqualified according to standards established by the Court. [Ord. 81, amended, 1/6/2023; Ord. 63, adopted, 12/6/2019.]
