In ruling on all motions, the Court and Appellate Court shall give greatest weight to relevant prior decisions of the Yurok Court; where such decisions do not exist, the Court will look first to the notions of fairness inherent in the Yurok culture, then to principles of fairness inherent in Yurok common law, and then may consider other Court decisions, federal decisions, and/or decisions of state courts so long as they do not conflict with Yurok cultural prerogatives.
