A person commits the offense of distribution of recreational marijuana if the person transports, sells, furnishes, administers, or gives away more than 28.5 grams of nonmedical, processed recreational marijuana, or attempts or offers to do so under YTC 15.10.190, or if the person sells any amount of marijuana, unless such person is registered or otherwise authorized pursuant to 21 U.S.C. Part C §§  821 through 831 to transport, sell, furnish, administer or give away marijuana.

(a) If a person sells any amount of marijuana, even if that amount is less than 28.5 grams, then that person would be guilty of violating this section.

(b) Those persons authorized pursuant to 21 U.S.C. Part C §§  821 through 831 will generally be licensed physicians and pharmacists issuing prescriptions for a legitimate medical purpose or federally registered pharmaceutical manufacturers.
