Either parent or an extended family member may petition the Tribal Court for resolution of a child custody dispute. If the issue of child custody is before the Court at the time it issues a decree of legal separation, dissolution of marriage, or declaration of invalidity of marriage under this Code, the Tribal Court shall concurrently issue a parenting plan under this chapter.
