The Tribal social worker shall report to the Court on the reasons why the child has been removed from the physical custody of the parent/guardian/caretaker and the need, if any, for continued removal. The Court shall order the release of the child from custody unless a prima facie showing has been made that the child is a CINA as defined in this title, the Court finds that continuance in the home of a parent/guardian/caretaker is contrary to the child’s welfare.
