Incident to an arrest for a crime of domestic abuse or an arrest for violation of a protective order, restraining order, or for violation of the terms and conditions of a release order, a law enforcement officer:

(a) Shall seize all weapons that are alleged to have been involved or threatened to be used in a commission of the crime; and

(b) May seize a weapon that is in the plain view of the officer or that was found pursuant to a consensual search, as necessary for the protection of the officer or the person(s) at scene or who will be protected by a restraining order, including an emergency protection order.
