For the purposes of this section, a “controlled substance” includes a drug or its immediate precursor classified in schedules I through V under the Federal Controlled Substances Act, 21 U.S.C. §§ 811 to 812. Any person who possesses, delivers or manufactures controlled substances, unless such substances were obtained pursuant to a prescription from a licensed professional authorized under state, federal or Tribal law to issue such prescription.
